Terms of Use & End-User License Agreement

These Terms of Use and End-User License Agreement (the "Terms") govern access to and use of the ThousandCranes platform — the business-management software, staff portals, customer portal, chat and phone assistants, scheduling links, and payment pages (together, the "Platform") — owned and operated by Quality Home Products of Texas ("QHP," "we," "us"). By accessing or using any part of the Platform, you agree to these Terms.

1. What the Platform is

ThousandCranes is QHP's internal, proprietary business platform. It is operated for a single business — QHP and its affiliated brands (including Living EcoWater and Premium Home Products) — and is not offered for sale, resale, sublicense, or use by any other business. Customer-facing portions (chat, the customer portal, scheduling and payment links) are provided to QHP's own customers and prospective customers as part of our services.

2. License

QHP grants you a limited, revocable, non-exclusive, non-transferable license to use the Platform solely:

No other rights are granted. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Platform; reverse-engineer or attempt to extract its source code except where the law permits; or use it to build a competing product.

Staff accounts are provisioned by QHP with role-based permissions; you are responsible for what happens under your credentials, and you must not share them or attempt to exceed your assigned permissions. Customer portal access is tied to your own service records. Notify us promptly of any suspected unauthorized use.

5. Automated assistants and scheduling

The chat and phone assistants are automated AI services. They work from the information you give them and, like any automated system, can make mistakes. Appointments and quotes arranged through an assistant are subject to confirmation and adjustment by QHP staff. Nothing an assistant says creates a warranty or modifies a signed agreement.

6. Payments

Payments made through the Platform are processed by our third-party payment processor. By submitting a payment you represent that you are authorized to use the payment method, and you authorize the charge described on the payment page or in your service agreement (including recurring charges you have agreed to, which you may cancel by contacting us). Payment card data is tokenized by the processor; QHP does not store full card numbers.

7. Electronic signatures and records

Where the Platform offers electronic completion and signing of documents, you consent to transact electronically. Your electronic signature has the same effect as a handwritten one, and completed documents are retained with integrity protections against alteration.

8. Ownership

The Platform — its software, design, text, graphics, and data compilations — is owned by QHP and protected by intellectual-property law. Your service records are maintained by QHP as business records; this section does not limit rights you have in your own personal data under our Privacy Policy or applicable law.

9. Third-party services

The Platform interoperates with third-party services — including Microsoft (hosting and sign-in), our payment processor, telephone and SMS carriers, Anthropic (AI), and Intuit QuickBooks Online (accounting data, under authorization from QHP's ownership, used solely for QHP's internal financial reporting). Those services are governed by their own terms and privacy policies, and QHP is not responsible for their acts or omissions.

Our collection and use of personal information is described in the Privacy Policy, which is part of these Terms.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, QHP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. This section does not limit any written warranty QHP provides for products or services you purchase — those are governed by their own agreements.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QHP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE PLATFORM. QHP'S TOTAL LIABILITY ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID QHP THROUGH THE PLATFORM IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Termination

QHP may suspend or terminate access to the Platform at any time, including for violation of these Terms. Staff access ends with employment or engagement. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, governing law) survive termination.

14. Changes

We may update these Terms as the Platform evolves. The effective date above reflects the current version; continued use after changes are posted constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Harris County, Texas.
